1. Introduction and Acceptance of Terms

Welcome to Shalini Cabs. These Terms & Conditions ("Terms") govern your access to and use of our website, mobile application, and transportation aggregator services (collectively, the "Services") provided by Shalini Cabs Private Limited ("we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

2. Description of Services

Shalini Cabs operates as a technology platform connecting registered users ("Riders") with independent third-party transportation providers ("Drivers"). We do not directly provide transportation services. Drivers operate as independent contractors under the Driver Subscriber Entrepreneur (DSE) model. Your contract for the actual transportation service is directly with the Driver.

3. User Accounts & Registration

• You must be at least 18 years old to create an account and use the Services.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or if you violate these Terms.

4. Booking and Fares

• Fares provided at the time of booking are estimates and may vary based on actual distance, wait times, traffic conditions, and applicable tolls/taxes.
• Toll charges, parking fees, and state entry taxes (where applicable) are generally extra and must be paid by the Rider unless explicitly stated otherwise in the booking voucher.
• All payments for extra charges must be settled directly with the Driver in cash or via authorized UPI at the end of the trip.

5. User Conduct and Responsibilities

While using our Services, you agree not to:

• Use the Services for any unlawful purpose or in any way that interrupts, damages, or impairs the service.
• Harass, abuse, or threaten the Drivers or our customer support staff.
• Carry illegal, hazardous, or dangerous materials in the vehicle.
• Cause damage to the vehicle. You will be held liable for any cleaning fees or repair costs resulting from your actions.

6. Driver Obligations

Our registered Drivers are expected to maintain professional conduct, keep vehicles clean and roadworthy, and comply with all applicable traffic laws and RTO regulations. While we vet our Drivers, we are not directly liable for the actions, omissions, or negligence of independent third-party Drivers.

8. Limitation of Liability

To the maximum extent permitted by law, Shalini Cabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or personal injury or property damage related to, in connection with, or otherwise resulting from any use of the Services.

9. Indemnification

You agree to indemnify and hold Shalini Cabs and its officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses arising out of or in connection with your use of the Services or your breach of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Thane, Maharashtra.

11. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Continued use of the Services after such changes constitutes your consent to the updated Terms.
